APARTMENT LEASE

          THIS AGREEMENT, dated this 1st day of June, yr 19961, by and between Patrick Small2 (name of tenant) of  330 First Street, Happy Willow, Ohio3 (address of tenant), hereinafter referred to as tenant, and Frank Bosworth4 (name of landlord) of 111 Summit Avenue, St. Paul, Minnesota5 (address of landlord), hereinafter referred to as landlord, recites the following terms and conditions:
          1. THE DESCRIPTION OF PREMISES: Tenant hereby agrees to rent the premises described as follows:

330 First Street, Happy Willow, Ohio6

          2. TERM: Tenant agrees to lease the above-described premises for a period of two(2)7 (months/years), commencing on the 1st day of June, yr 19968, and ending on the 31st day of May, yr 19989.
          3. RENTAL AMOUNT: Tenant agrees to rent the aforementioned premises for the amount of $49510 per month, payable on the 1st11 day of each month after the 1st day of June, yr 199612, the date of the first rental payment.
          4. SPECIAL CONDITIONS: Tenant agrees to be bound by the special conditions for the premises as set out in the attached Rules and Regulations.
          5. CONDITION OF PREMISES: Tenant agrees to maintain the premises in good condition at all times during possession and shall be certain that the premises are maintained in the condition as the premises were when first received by the tenant. In the event there are any problems with the premises that involve damage of any sort, the tenant must bring such matters to the immediate attention of the landlord.
          6. DAMAGE DEPOSIT: Tenant agrees to place with the landlord a damage deposit equal to one month's rent, which is the amount of $49513.
          7. SURRENDER OF PREMISES: Tenant shall surrender the premises to the landlord immediately upon termination of this agreement.

          8. TERMINATION: In the event tenant fails to perform any of the conditions of this lease, the landlord shall have the option to provide notice to the tenant of tenant's failure to comply. Landlord shall have the rights of the three day notice to quit in the event of non-compliance with this agreement or in the event of nonpayment of rent in conjunction with this lease.
          9. USE: Tenant shall use the premises for living purposes14 only and may not use the premise for any other purpose without the expressed written consent of the landlord.
          10. RIGHT TO ENTER: Landlord shall have the right to enter the premises at any reasonable time for the purpose of inspection.
          11. APPLICABLE LAW: The law that governs this Agreement is the law of the State of Ohio15. In the event the landlord finds it necessary to enforce the provisions of this agreement against the tenant, the landlord shall be entitled to reasonable attorney's fees and costs.  (See Ohio Statutes)16.

The form above is an example of how a typical Apartment Lease form may be completed.

  1. This date reflects the date the document is signed between the parties.

  2. The full name of the tenant.

  3. The address of the tenant.  Generally, this is the same address as that of the premises that the tenant rents from the landlord.

  4. The full name of the landlord.  Sometimes this is a corporation, in which case the agent of the corporation would sign at the bottom of the agreement.

  5. The address of the landlord.  Oftentimes, this is the same address as the address of the tenant, depending upon the facility that is rented.

  6. The location of the premises is described in this space and, on occasion, this may be different from number 3 above.  Sometimes the legal description may be required; however, often just the street address is sufficient.

  7. Either the number of months or years for which the lease applies.

  8. The day the lease agreement commences to run.

  9. The day the lease terminates or ends.

  10. The amount of rental per month.

  11. The day of each month when the rental amount is due.

  12. The day the first rental payment is due; most generally, this coincides with the first date of possession.

  13. This is the amount of the damage deposit.  Sometimes this is regulated by state statute or by city statute, such as in the case of New York.

  14. The use of the premises should be described at this juncture.

  15. The state under which the agreement may be enforced.

  16. Although not necessary in most states, often a statute is cited.

  17. Additional provisions are included in this space and, in this case, an example of no pets has been set forth.

  18. Signature of the tenant.

  19. Signature of the landlord.
