| What is an illegal contract? |
| An illegal contract exists where the formation of the contract or the performance of the contract is expressly forbidden by the state’s statutes or by federal statutes. The statute may either be civil or criminal in nature and occurs where a penalty is imposed by law for the execution or completion of some act that is determined by state law to be against public policy and, therefore, illegal. |
