  3. More than 30 days have elapsed since the service of the Summons and Complaint, and Respondent has not submitted an Answer to the Complaint.

  4. Respondent is in default and Petitioner prays for judgment in accordance with the law.

  5. Upon information and belief, the Respondent is not in the military service of the United States.

This Affidavit is made in compliance with the Soldiers' and Sailors' Civil   Relief Act of 1940, as amended.
